The airline asserts the system uses aggregated market and booking data to inform human pricing analysts, and does not use personal or sensitive customer information. Despite these claims, consumer advocates and lawmakers—including Senators Gallego, Warner, and Blumenthal—have raised concerns about fairness, transparency, and potential "surveillance pricing," and Representatives Casar and Tlaib have proposed legislation to forbid AI-based pricing tied to individual data. U.S. Transportation Secretary Sean Duffy also warned of federal investigation if AI is used to personalize fares based on attributes like income or identity. Delta maintains that its AI tool serves as a “super analyst,” boosting revenue without exploiting individual passengers.
